Legal Protection of Personal Data in the Use of Social Networks

The use of social networks as a means of communication and participation in public life has become an integral part of the everyday life of modern internet users. By creating personal profiles and actively participating in these platforms, individuals provide a significant amount of personal data, which is used for various purposes, including information exchange, advertising, and online services. This process inevitably raises issues related to the legal protection of personal data, as such data is often provided formally, without a real assessment of the risks and consequences for the data subject.

Social networks operate on the basis of voluntary sharing of personal information, and already at the registration stage users accept general terms and conditions that regulate the processing of their data. In practice, this leads to situations in which personal information is provided in a broad scope, without users clearly understanding how and by whom it may be used. This environment creates prerequisites for the unlawful use of personal data by third parties, which emerges as one of the main legal risks associated with the use of social networks.

A particularly serious issue is identity theft, which is carried out through the use of another person’s identifying data in order to gain access to resources, financial benefits, or to commit fraudulent acts. In such cases, personal data disclosed online becomes a tool for unlawful conduct, with consequences for the affected person that may be both material and non-material. Social networks further facilitate such abuses, as they often contain photographs, contact details, and other information that enables easy identification and impersonation.

In addition to identity theft, the use of social networks entails risks related to online harassment and the dissemination of false or defamatory information. Such behavior is usually carried out through electronic means and may include systematic sending of offensive messages, publication of compromising content, or spreading rumors, including under a stolen identity. These actions affect fundamental personal rights and raise the issue of effective legal protection in the digital environment.

The legal protection of personal data in the context of social networks is of particular importance, as internet users do not always possess sufficient awareness of how their information is processed. Formal acceptance of terms and careless sharing of personal data increase vulnerability to abuse. In this sense, personal data protection should be viewed as part of the broader protection of personality rights, rather than merely a technical or organizational issue.

Reducing the risks arising from the use of social networks is directly linked to increasing users’ legal awareness and digital literacy. Understanding the consequences of sharing personal information and adopting a cautious approach to its publication can significantly limit opportunities for abuse. Thus, legal protection is complemented by the personal responsibility of internet users, which is essential for security in the online environment.

In conclusion, social networks offer significant conveniences for communication and participation in public life, but at the same time create real legal risks related to users’ personal data. Identity theft, unlawful use of information, and online harassment are among the most serious threats resulting from careless or uninformed handling of personal information. Effective legal protection in this area requires a combination of clear rules and protective mechanisms, together with increased awareness and responsible behavior on the part of users.
