Challenging the Contents of a Document in Civil Proceedings

Under Article 180 of the Bulgarian Code of Civil Procedure, a signed private document proves that the statements contained in it were made by the person who signed it. This is the document’s formal evidentiary effect.

Authenticity and truthfulness are different issues

A document may be authentic because the signature and statement originate from the stated person, yet contain an inaccurate account of the underlying facts. Challenging authorship is therefore different from disputing the truth of what the document records.

Statements against the issuer’s interest

When a private evidentiary document records facts adverse to its issuer, the statement may have evidentiary significance regarding those facts. A party who asserts that its own recorded admission is untrue generally bears the burden of rebutting it, subject to the applicable procedural rules and restrictions on witness evidence.

Timely procedural action

The type of challenge, the relevant time limit and the admissible evidence depend on the document and on the allegations made in the proceedings. A statement of claim, summons or other court paper should therefore be reviewed without delay so that no procedural deadline is missed.
