Use of False Documents as a Threat to Public Order and Legal Consequences in Bulgaria

The use of false documents poses a serious threat to public order and security, which is why Bulgarian legislation provides for severe penalties for such acts. This article examines the legal implications of a situation where a person is detained after presenting a false identity document.

     1. Legal Qualification of the Act

According to Article 308, paragraph 1 of the Bulgarian Criminal Code: “Anyone who forges an official document or alters the content of an official document with the intent to use it shall be punished for document forgery with imprisonment of up to three years.”

In the present case, the individual’s behavior may be qualified as the use of a forged official document. If the person is not the author of the forgery but has used the document, they may still be held criminally liable as an accomplice (Article 20 CC) or individually under Article 308, paragraph 1 CC.

     2. Procedural Actions Upon Detention

When law enforcement authorities detect inconsistencies or suspect the authenticity of a presented document, they may undertake the following actions:

  • Establishing identity – if there are suspicions of a fake document, the police are obligated to check official databases and/or request additional identity verification.

  • Detention under Article 72 of the Ministry of Interior Act – for up to 24 hours where there is a suspicion of a committed crime.

  • Initiation of pre-trial proceedings – if sufficient evidence of a crime exists, criminal proceedings are opened under Article 207 et seq. of the Criminal Procedure Code (CPC).

  • Appointment of expert examination – usually a forensic technical expertise is assigned to verify the document’s authenticity.

     3. Application of Coercive Measures

After the detention, the prosecutor may request a coercive measure such as “detention in custody,” “house arrest,” or “bail,” depending on the severity of the crime and the individual’s danger to society.

    4. Distinction from Administrative Offenses

It is essential to distinguish between the criminal use of a forged document and administrative offenses such as using expired, invalid, or incorrectly issued identity documents. These are regulated under the Bulgarian Personal Documents Act and may lead to fines but not criminal charges.

    5. International Aspect

In the case of foreign nationals found with forged documents, the competent authorities must notify the “Migration” Directorate of the Ministry of Interior. Administrative detention and proceedings under the Foreigners in the Republic of Bulgaria Act may follow, including possible deportation.
