The outcome depends on the precise legal classification, the value of the property, how the offence was committed, the evidence, compensation for the damage and the accused’s personal circumstances. The absence of previous convictions is important, but it is only one of the factors assessed.

What does a “first charge” mean?

A distinction must be made between a person formally charged for the first time and a person who has no conviction for an offence prosecuted by the state. Someone may previously have been investigated or charged in other proceedings without having been convicted. Conversely, an earlier conviction, exemption from criminal liability or pending case may affect the applicable procedure.

The defence therefore checks the criminal record, any rehabilitation, previous application of Article 78a of the Criminal Code and whether the conditions for a repeat offence or recidivism exist. The expression “first offence” is no substitute for this specific legal review.

What punishment does theft carry?

For the basic offence under Article 194(1) of the Criminal Code, the law provides for imprisonment of up to eight years. This is the statutory range, not a sentence that must be imposed in every case. When determining the sentence, the court considers the degree of social danger of the act and the offender, the motives, method, value of the property, damage caused and all mitigating and aggravating circumstances.

For a minor case under Article 194(3), the penalty is substantially lighter: imprisonment of up to one year, probation or a fine. Breaking in, using a technical device, prior agreement and other features may amount to aggravated theft under Article 195, carrying more serious liability.

Does a clean criminal record guarantee a suspended sentence?

No. A suspended sentence under Article 66 is a possibility, not an automatic right. It may be applied where the court imposes imprisonment of up to three years, the person has not previously been sentenced to imprisonment for an offence prosecuted by the state, and the court finds that actual service of the sentence is unnecessary.

Where these conditions are met, execution may be suspended for a period of three to five years. A new offence during this period may lead to enforcement of the suspended sentence as well. A suspended sentence therefore remains a conviction and should not be viewed as an acquittal or termination of the case.

When can a fine or administrative liability apply?

For minor cases, the special rules of Article 218b must be considered. Where the value of the property does not exceed two minimum monthly wages at the date of the act, the property has been returned or replaced and the other statutory conditions are met, a fine may be imposed through an administrative procedure. Any statutory bar excludes this route.

For an intentional offence punishable by up to three years, the application of Article 78a may also be examined. The person must simultaneously have no conviction for an offence prosecuted by the state, not have previously been exempted under this procedure, have compensated the property damage, and fall outside any statutory exception. The court then exempts the person from criminal liability and imposes an administrative fine. The basic theft offence under Article 194(1) carries a maximum above three years and does not itself satisfy this requirement, but a less serious classification may change the assessment.

What effect does returning the property have?

Voluntarily returning or replacing the stolen property before the close of the evidentiary stage at first instance may lead to a reduced penalty in the cases specified in Article 197. Compensation also matters when individualising the sentence, applying Article 78a and considering administrative liability.

However, it does not automatically erase the act or make every case eligible for termination. It has the effects of a final conviction. Before signing, the legal classification, sentence, costs, disposal of property and all consequences for the accused must be clear.

What circumstances may mitigate liability?

Commonly relevant factors include a clean criminal record, youth, employment, positive character evidence, low value, the isolated nature of the act, cooperation and voluntary compensation. An admission may be relevant, but it should be informed and supported by the other evidence.

Where mitigating circumstances are exceptional or numerous, Article 55 permits a sentence below the statutory minimum or substitution with a lighter penalty. This requires a specific judicial assessment and does not follow merely from the charge being the first.

What should the defence examine?

whether the offender’s identity and intent to appropriate have been proved;

whether ownership and the property’s value have been correctly established;

whether there are grounds for a minor case or a less serious classification;

whether recordings, testimony, identification evidence and seized property were obtained lawfully;

whether all property damage forming part of the offence has been compensated;

whether Articles 197, 218b, 78a or 66 apply;

whether a premature admission or agreement risks worsening the accused’s position.

For more on examining video footage, witnesses and identification, see “Evidence in theft cases”.

Why is early legal assistance important?

Initial explanations, voluntary surrender of items, searches and identification procedures can shape the entire proceedings. The defence should formulate its position after reviewing the materials, rather than relying solely on a promise of a lighter sentence.

Related articles

Theft under Article 194 of the Criminal Code

Minor cases of theft

This material provides general information and does not constitute legal advice on a particular case.

If you need advice on a criminal law matter, you may contact attorney Mihail Tomov, a member of the Varna Bar Association.

First theft charge in Bulgaria: penalties, suspended sentences, returning property and the defence options that depend on the facts of the case.

[1

post-3595","post","type-post","status-publish","format-standard","hentry","category-1
["GET
