Possession of drugs with intent to distribute differs from possession for personal use because the prosecution must establish a further purpose: transfer of the substance to other persons. That purpose is inferred from the entire factual context.<\/p>\n
Quantity alone does not automatically prove intent to distribute. The court assesses it together with the type of substance, packaging, scales, cash, communications, observed conduct, explanations and other evidence.<\/p>\n
Each item must be lawfully obtained, reliable and interpreted in context. Everyday objects or ambiguous messages do not necessarily have only one explanation.<\/p>\n
The prosecution must also prove that the accused knowingly exercised factual control over the substance. Mere presence in a shared home or vehicle does not automatically establish possession. Ownership, access, location, fingerprints, statements and the conduct of all persons present may be relevant.<\/p>\n
Important issues include the legality of the search and seizure, the exact location of each object, packaging and seals, the chemical examination, extraction and interpretation of electronic data, witness reliability and whether alternative explanations were investigated.<\/p>\n
The purpose of distribution must be proved beyond reasonable doubt from a coherent body of evidence. It should not be presumed solely from quantity or from one isolated circumstance.<\/p>\n
