At the same time, not every evidentiary means containing information about a committed crime may be used by the court when forming its inner conviction. Bulgarian criminal procedural law establishes clear limits regarding the admissibility of evidence, emphasizing the lawfulness of its collection and verification.<\/p>\n<p data-start=\"739\" data-end=\"934\">The institution of inadmissible evidence aims to guarantee the fairness of criminal proceedings and to prevent the use of evidentiary means obtained in violation of fundamental procedural rights.<\/p>\n<p data-start=\"936\" data-end=\"1189\">Inadmissible evidence consists of evidentiary means that have been collected, examined, or admitted to the criminal proceedings in breach of mandatory procedural rules or through infringement of the fundamental rights of the participants in the process.<\/p>\n<p data-start=\"1191\" data-end=\"1401\">Their inadmissibility derives not from their content, but from the manner in which they were obtained. Even if the evidence indicates the commission of a crime, it may not be used if it was acquired unlawfully.<\/p>\n<p data-start=\"1403\" data-end=\"1629\">The legal regulation of the admissibility of evidence is mainly contained in the Criminal Procedure Code, which requires evidence to be collected and examined in accordance with the procedures and conditions prescribed by law.<\/p>\n<p data-start=\"1631\" data-end=\"1689\">The inadmissibility of evidence is also closely linked to:<\/p>\n<ul data-start=\"1690\" data-end=\"1859\">\n<li data-start=\"1690\" data-end=\"1770\">\n<p data-start=\"1692\" data-end=\"1770\">Article 56 of the Constitution of the Republic of Bulgaria (right of defense);<\/p>\n<\/li>\n<li data-start=\"1771\" data-end=\"1803\">\n<p data-start=\"1773\" data-end=\"1803\">the principle of a fair trial;<\/p>\n<\/li>\n<li data-start=\"1804\" data-end=\"1859\">\n<p data-start=\"1806\" data-end=\"1859\">Article 6 of the European Convention on Human Rights.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"1861\" data-end=\"1983\">Judicial practice consistently holds that the use of inadmissible evidence constitutes a substantial procedural violation.<\/p>\n<h3 data-start=\"1990\" data-end=\"2038\"><strong data-start=\"1994\" data-end=\"2038\">Main Categories of Inadmissible Evidence<\/strong><\/h3>\n<p data-start=\"2040\" data-end=\"2133\">In practice, the following categories of inadmissible evidence are most commonly encountered:<\/p>\n<ol data-start=\"2135\" data-end=\"2933\">\n<li data-start=\"2135\" data-end=\"2334\">\n<p data-start=\"2138\" data-end=\"2334\"><strong data-start=\"2138\" data-end=\"2196\">Evidence obtained in violation of the right of defense<\/strong><br data-start=\"2196\" data-end=\"2199\" \/>Cases in which the accused was deprived of legal counsel, was not duly informed of their rights, or was compelled to give explanations.<\/p>\n<\/li>\n<li data-start=\"2336\" data-end=\"2527\">\n<p data-start=\"2339\" data-end=\"2527\"><strong data-start=\"2339\" data-end=\"2389\">Evidence collected by an incompetent authority<\/strong><br data-start=\"2389\" data-end=\"2392\" \/>Where a procedural action has been carried out by an authority lacking material or functional competence, its results are inadmissible.<\/p>\n<\/li>\n<li data-start=\"2529\" data-end=\"2752\">\n<p data-start=\"2532\" data-end=\"2752\"><strong data-start=\"2532\" data-end=\"2596\">Evidence obtained through a substantial procedural violation<\/strong><br data-start=\"2596\" data-end=\"2599\" \/>For example, absence of mandatory participants, failure to observe required form, or performance of actions without the necessary judicial authorization.<\/p>\n<\/li>\n<li data-start=\"2754\" data-end=\"2933\">\n<p data-start=\"2757\" data-end=\"2933\"><strong data-start=\"2757\" data-end=\"2818\">Evidence obtained through violation of fundamental rights<\/strong><br data-start=\"2818\" data-end=\"2821\" \/>Such as evidence acquired through unlawful surveillance, search, or seizure in breach of statutory requirements.<\/p>\n<\/li>\n<\/ol>\n<h3 data-start=\"2940\" data-end=\"3004\"><strong data-start=\"2944\" data-end=\"3004\">Distinction Between Inadmissible and Unreliable Evidence<\/strong><\/h3>\n<p data-start=\"3006\" data-end=\"3097\">A clear distinction must be made between \u201cinadmissible evidence\u201d and \u201cunreliable evidence\u201d.<\/p>\n<ul data-start=\"3099\" data-end=\"3320\">\n<li data-start=\"3099\" data-end=\"3197\">\n<p data-start=\"3101\" data-end=\"3197\"><strong data-start=\"3101\" data-end=\"3126\">Inadmissible evidence<\/strong> is procedurally invalid due to the manner in which it was collected.<\/p>\n<\/li>\n<li data-start=\"3198\" data-end=\"3320\">\n<p data-start=\"3200\" data-end=\"3320\"><strong data-start=\"3200\" data-end=\"3223\">Unreliable evidence<\/strong> is evidence that, by its nature, cannot establish relevant facts or is internally contradictory.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"3322\" data-end=\"3443\">This distinction is significant for procedural consequences and for the manner in which the court motivates its decision.<\/p>\n<h3 data-start=\"3450\" data-end=\"3501\"><strong data-start=\"3454\" data-end=\"3501\">Consequences of Using Inadmissible Evidence<\/strong><\/h3>\n<p data-start=\"3503\" data-end=\"3583\">The use of inadmissible evidence leads to serious legal consequences, including:<\/p>\n<ul data-start=\"3584\" data-end=\"3808\">\n<li data-start=\"3584\" data-end=\"3642\">\n<p data-start=\"3586\" data-end=\"3642\">exclusion of the evidence from the evidentiary material;<\/p>\n<\/li>\n<li data-start=\"3643\" data-end=\"3713\">\n<p data-start=\"3645\" data-end=\"3713\">return of the case for removal of substantial procedural violations;<\/p>\n<\/li>\n<li data-start=\"3714\" data-end=\"3754\">\n<p data-start=\"3716\" data-end=\"3754\">annulment of the judgment or decision;<\/p>\n<\/li>\n<li data-start=\"3755\" data-end=\"3808\">\n<p data-start=\"3757\" data-end=\"3808\">engagement of the state\u2019s liability under the ECHR.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"3810\" data-end=\"3982\">Judicial practice holds that where inadmissible evidence has been decisive for forming the court\u2019s inner conviction, the violation vitiates the entire criminal proceedings.<\/p>\n<h3 data-start=\"3989\" data-end=\"4040\"><strong data-start=\"3993\" data-end=\"4040\">Significance for the Defense and Disclaimer<\/strong><\/h3>\n<p data-start=\"4042\" data-end=\"4319\">From the perspective of the defense, the timely identification and challenge of inadmissible evidence is a key element of procedural strategy. Active defense during the pre-trial phase may prevent the admission of such evidence and decisively influence the outcome of the case.<\/p>\n<p data-start=\"4321\" data-end=\"4723\">In conclusion, the institution of inadmissible evidence represents a balance between the state\u2019s interest in criminal prosecution and the protection of fundamental individual rights. Criminal justice does not allow the achievement of its objectives through unlawful means.
