The historical development of computer crime is closely linked to the evolution of computer technologies and digital communications. The emergence of ARPANET as the first computer network marks the beginning of the transformation of isolated computer systems into a global environment for information exchange. In its early stages, the first cases of unauthorized access were not perceived as criminal acts, as society and the legal framework lacked the conceptual tools to assess the social danger of such conduct. For this reason, early hacking activities were viewed as demonstrations of technical skills rather than infringements upon legally protected interests.<\/p>\n
With the expansion of the Internet and the rise of networks enabling the exchange of personal, financial, and corporate data, computer crime acquired a transnational and global character. Hackers were no longer constrained by the physical location of their victims. Individual users, state institutions, and multinational corporations became targets of anonymous perpetrators. During this period, it became evident that such actions affect key legally protected societal interests related to privacy, property, and national security. This prompted the gradual development of international standards and mechanisms for counteraction. INTERPOL and Europol established specialized cybercrime units, and states began adopting the first criminal law provisions addressing these offenses.<\/p>\n
The Bulgarian legal system followed the same trajectory. Initially, acts committed by means of a computer were classified under general criminal provisions such as fraud or document-related offenses. However, the development of the digital environment necessitated the adoption of specialized norms. Thus, the Criminal Code introduced provisions regulating unlawful access to information systems, manipulation of computer data, and the use of foreign payment instruments. Chapter Nine \u201ca\u201d and Article 212a represent an attempt to criminalize part of the spectrum of cybercriminal activity. Nonetheless, these provisions were created during a technological era vastly different from today\u2019s digital reality. This leads to the core legal problem: legislation inevitably lags behind technological progress and the rapidly evolving models of criminal behavior.<\/p>\n
