It is the property inhabited by the spouses and their children before the dissolution of the marriage, or in cases of de facto separation \u2014 until the date of that separation.<\/p>\n<p data-start=\"2414\" data-end=\"2563\">Therefore, upon divorce, <strong data-start=\"2439\" data-end=\"2501\">either spouse may request the right to use the family home<\/strong>, provided it was the marital residence prior to separation.<\/p>\n<p data-start=\"2565\" data-end=\"2771\">Under <strong data-start=\"2571\" data-end=\"2604\">Article 26 of the Family Code<\/strong>, any <strong data-start=\"2610\" data-end=\"2641\">disposal of the family home<\/strong>, when it is owned personally by one spouse, requires <strong data-start=\"2695\" data-end=\"2730\">the consent of the other spouse<\/strong>, if they do not have another dwelling.<\/p>\n<p data-start=\"2773\" data-end=\"2899\">Claims regarding the family home are filed with the <strong data-start=\"2825\" data-end=\"2853\">competent District Court<\/strong>, represented by a duly authorized attorney.<\/p>\n<p data-start=\"2903\" data-end=\"3085\"><em>This article does not constitute legal advice.
