Liability for Workplace Accidents under Article 200 of the Labour Code \u2013 Scope and Exceptions"},"content":{"rendered":"<p><\/p>\n<p data-start=\"144\" data-end=\"748\"><strong data-start=\"144\" data-end=\"332\">In Bulgarian labour law, one of the most important guaranteed rights of the worker is the right to compensation for damages resulting from a workplace accident or occupational disease.<\/strong><br data-start=\"332\" data-end=\"335\" \/>This liability is regulated by <strong data-start=\"366\" data-end=\"405\">Article 200 of the Labour Code (LC)<\/strong> and represents <strong data-start=\"421\" data-end=\"469\">strict (objective) liability of the employer<\/strong> \u2013 i.e. the employer owes compensation regardless of whether they are at fault for the incident.<br data-start=\"565\" data-end=\"568\" \/>The purpose of this rule is to protect the worker who has suffered harm while performing their job duties, without having to prove fault on the part of the employer or their staff.<\/p>\n<p data-start=\"750\" data-end=\"1559\">According to <strong data-start=\"763\" data-end=\"801\">Article 200, paragraph 1 of the LC<\/strong>, when in the course of or in connection with the performance of job duties there occurs <strong data-start=\"890\" data-end=\"986\">damage to health, temporary incapacity for work, permanent disability or death of the worker<\/strong>, the employer is obliged to pay the injured worker or their heirs <strong data-start=\"1053\" data-end=\"1132\">compensation for all pecuniary (property) and non-pecuniary (moral) damages<\/strong>.<br data-start=\"1133\" data-end=\"1136\" \/>Pecuniary damages (i.e. financial losses) include costs for treatment, medicines, transportation, rehabilitation, as well as lost income due to reduced working capacity.<br data-start=\"1305\" data-end=\"1308\" \/>Non-pecuniary damages (i.e. moral damages) refer to pain, suffering, psychological trauma, loss of enjoyment of life, etc. \u2013 these are harms that cannot be calculated with an exact sum, so the court determines their amount <strong data-start=\"1531\" data-end=\"1559\">\u201caccording to fairness.\u201d<\/strong><\/p>\n<p data-start=\"1561\" data-end=\"2024\">This liability of the employer is <strong data-start=\"1595\" data-end=\"1655\">different and separate from the social-security payments<\/strong> (e.g. cash benefits from the NSSI for temporary incapacity for work or survivor pensions).<br data-start=\"1746\" data-end=\"1749\" \/>By law, the injured person may receive both \u2013 the state social-security payments and the compensation from the employer.<br data-start=\"1869\" data-end=\"1872\" \/>The aim of the compensation under <strong data-start=\"1906\" data-end=\"1924\">Article 200 LC<\/strong> is to fully and effectively cover all damages <strong data-start=\"1971\" data-end=\"2023\">not covered by the public social-security system<\/strong>.<\/p>\n<h3 data-start=\"2031\" data-end=\"2054\">Limits of Liability<\/h3>\n<p data-start=\"2056\" data-end=\"2416\">The employer\u2019s strict liability is not unlimited.<br data-start=\"2105\" data-end=\"2108\" \/><strong data-start=\"2108\" data-end=\"2146\">Article 200, paragraph 2 of the LC<\/strong> provides that where damages have already been partially or fully compensated by public social security (e.g. pensions or benefits received), the employer owes only the difference up to the full amount of the damages.<br data-start=\"2363\" data-end=\"2366\" \/>This avoids double compensation for the same harm.<\/p>\n<p data-start=\"2418\" data-end=\"2804\">In the case-law of the <strong data-start=\"2441\" data-end=\"2477\">Supreme Court of Cassation (SCC)<\/strong> it has been clarified that the employer also owes compensation for <strong data-start=\"2545\" data-end=\"2563\">future damages<\/strong> \u2013 for example, loss of income where the injury leads to long-term reduction in working capacity.<br data-start=\"2660\" data-end=\"2663\" \/>The compensation is calculated based on the worker\u2019s average monthly income prior to the accident and the anticipated duration of incapacity.<\/p>\n<h3 data-start=\"2811\" data-end=\"2852\">Exceptions and Release from Liability<\/h3>\n<p data-start=\"2854\" data-end=\"3338\">Although strict, the employer\u2019s liability is <strong data-start=\"2899\" data-end=\"2931\">not absolutely unconditional<\/strong>.<br data-start=\"2932\" data-end=\"2935\" \/>The law allows exemption in specifically defined cases.<br data-start=\"2990\" data-end=\"2993\" \/>Under <strong data-start=\"2999\" data-end=\"3044\">Article 200, paragraphs 2 and 3 of the LC<\/strong>, the employer is not liable if the accident was caused <strong data-start=\"3100\" data-end=\"3147\">entirely by the fault of the injured person<\/strong> or occurred as a result of <strong data-start=\"3175\" data-end=\"3192\">force majeure<\/strong>.<br data-start=\"3193\" data-end=\"3196\" \/>Force majeure refers to an unforeseeable and unavoidable extraordinary event \u2013 for example, natural disasters such as earthquakes or floods.<\/p>\n<p data-start=\"3340\" data-end=\"3803\">When the worker\u2019s conduct has <strong data-start=\"3370\" data-end=\"3399\">contributed to the damage<\/strong> \u2013 i.e. they share some responsibility for its occurrence (e.g. gross violation of safety rules), the court may <strong data-start=\"3511\" data-end=\"3548\">reduce the amount of compensation<\/strong> \u2013 this is the so-called <strong data-start=\"3573\" data-end=\"3602\">\u201ccontributory negligence\u201d<\/strong> under <strong data-start=\"3609\" data-end=\"3627\">Article 201 LC<\/strong>.<br data-start=\"3628\" data-end=\"3631\" \/>If the fault lies entirely with the injured person \u2013 e.g. deliberate self-harm or severe abuse of alcohol\/drugs at work \u2013 the employer may be fully released from liability.<\/p>\n<p data-start=\"3805\" data-end=\"4040\">The Supreme Court\u2019s case-law emphasises that <strong data-start=\"3850\" data-end=\"3930\">the burden of proof for these exempting circumstances lies with the employer<\/strong>.<br data-start=\"3931\" data-end=\"3934\" \/>They must prove that it was the worker\u2019s conduct or force majeure that was the sole cause of the accident.<\/p>\n<h3 data-start=\"4047\" data-end=\"4077\">Interaction with Insurance<\/h3>\n<p data-start=\"4079\" data-end=\"4629\">Many employers have taken out <strong data-start=\"4109\" data-end=\"4151\">mandatory workplace accident insurance<\/strong> under <strong data-start=\"4158\" data-end=\"4209\">Article 52 of the Health and Safety at Work Act<\/strong> and Ordinance No. 8\/2005.<br data-start=\"4235\" data-end=\"4238\" \/>The insurer pays compensation in the event of an accident, but this <strong data-start=\"4306\" data-end=\"4381\">does not release the employer from their liability under Article 200 LC<\/strong> \u2013 the employer remains liable for the difference between the full amount of the damages and what is received from the insurer.<br data-start=\"4508\" data-end=\"4511\" \/>The SCC has held that the worker may claim directly against the employer, who can then seek recourse from the insurer.<\/p>\n<h3 data-start=\"4636\" data-end=\"4670\">Procedure for Bringing a Claim<\/h3>\n<p data-start=\"4672\" data-end=\"5086\">Compensation under <strong data-start=\"4691\" data-end=\"4709\">Article 200 LC<\/strong> is sought by filing a <strong data-start=\"4732\" data-end=\"4749\">civil lawsuit<\/strong> before the competent <strong data-start=\"4771\" data-end=\"4801\">district or regional court<\/strong> depending on the amount claimed (<strong data-start=\"4835\" data-end=\"4884\">Article 104 of the Civil Procedure Code \u2013 CPC<\/strong>).<br data-start=\"4886\" data-end=\"4889\" \/>The claim may be brought <strong data-start=\"4914\" data-end=\"4931\">independently<\/strong> or after the administrative procedure before the NSSI for recognition of the workplace accident.<br data-start=\"5028\" data-end=\"5031\" \/>To succeed, the injured party must provide evidence of:<\/p>\n<ol data-start=\"5088\" data-end=\"5302\">\n<li data-start=\"5088\" data-end=\"5189\">\n<p data-start=\"5091\" data-end=\"5189\">The occurrence of a workplace accident (recognized by an NSSI decision or established in court);<\/p>\n<\/li>\n<li data-start=\"5190\" data-end=\"5245\">\n<p data-start=\"5193\" data-end=\"5245\">The amount of pecuniary and non-pecuniary damages;<\/p>\n<\/li>\n<li data-start=\"5246\" data-end=\"5302\">\n<p data-start=\"5249\" data-end=\"5302\">The causal link between the incident and the damages.<\/p>\n<\/li>\n<\/ol>\n<p data-start=\"5304\" data-end=\"5503\">The limitation period for bringing such a claim is <strong data-start=\"5355\" data-end=\"5369\">five years<\/strong> from the date of the accident under the general statute of limitations in <strong data-start=\"5444\" data-end=\"5502\">Article 110 of the Obligations and Contracts Act (OCA)<\/strong>.<\/p>\n<h3 data-start=\"5510\" data-end=\"5543\">Practical Issues and Case-Law<\/h3>\n<p data-start=\"5545\" data-end=\"5933\">Courts often face disputes over the <strong data-start=\"5581\" data-end=\"5616\">amount of non-pecuniary damages<\/strong>.<br data-start=\"5617\" data-end=\"5620\" \/>A <strong data-start=\"5622\" data-end=\"5661\">Supreme Court interpretative ruling<\/strong> emphasises that such damages must be fair and reflect the actual pain and suffering of the injured person.<br data-start=\"5768\" data-end=\"5771\" \/>The amount is determined individually, taking into account the severity of the injury, the victim\u2019s age, the duration of treatment and the permanent consequences.<\/p>\n<p data-start=\"5935\" data-end=\"6260\">In another line of case-law the SCC holds that when the injured person has <strong data-start=\"6010\" data-end=\"6041\">contributed to the accident<\/strong>, the compensation is reduced in proportion to their degree of fault, with the court assessing factors such as whether safety rules were violated, whether the worker had been instructed, or whether alcohol was involved.<\/p>\n<h3 data-start=\"6267\" data-end=\"6281\">Conclusion<\/h3>\n<p data-start=\"6283\" data-end=\"6843\">Employer liability under <strong data-start=\"6308\" data-end=\"6326\">Article 200 LC<\/strong> is a key element in the protection of workers in cases of workplace accidents.<br data-start=\"6405\" data-end=\"6408\" \/>It ensures <strong data-start=\"6419\" data-end=\"6455\">full compensation of all damages<\/strong> without requiring the worker to prove the employer\u2019s fault.<br data-start=\"6515\" data-end=\"6518\" \/>At the same time, the law protects the employer by allowing exemption or reduction of liability in cases of force majeure or contributory negligence by the injured party.<br data-start=\"6688\" data-end=\"6691\" \/>The SCC\u2019s practice requires a <strong data-start=\"6721\" data-end=\"6750\">fair balance of interests<\/strong> between both parties and strict application of the legal requirements and rules of evidence.<\/p>\n<p data-start=\"6845\" data-end=\"7177\">For successful enforcement of these rights, the injured party must have proper evidence of the accident and the damages, and must observe all procedural deadlines.<br data-start=\"7008\" data-end=\"7011\" \/>In most cases, <strong data-start=\"7026\" data-end=\"7106\">legal assistance from a lawyer experienced
