The specifics concerning <strong data-start=\"297\" data-end=\"329\">state and municipal property<\/strong> stem from the distinction between <strong data-start=\"364\" data-end=\"374\">public<\/strong> and <strong data-start=\"379\" data-end=\"390\">private<\/strong> state\/municipal ownership and from the historical <strong data-start=\"441\" data-end=\"483\">moratorium on acquisitive prescription<\/strong>, declared unconstitutional in 2022.<\/p>\n<h3 data-start=\"521\" data-end=\"543\">1. Legal framework<\/h3>\n<p data-start=\"545\" data-end=\"937\"><strong data-start=\"545\" data-end=\"567\">Property Act (ZS).<\/strong> Article 86 ZS categorically excludes acquisitive prescription for property constituting <strong data-start=\"656\" data-end=\"695\">public state or municipal ownership<\/strong>. For all other properties (including <strong data-start=\"733\" data-end=\"760\">private state\/municipal<\/strong> property) the general rules of acquisitive prescription under Article 79 ZS apply (ordinary\u201410 years; short\u20145 years where there is good faith and a valid legal ground (title)).<\/p>\n<p data-start=\"939\" data-end=\"1248\"><strong data-start=\"939\" data-end=\"968\">State Property Act (ZDS).<\/strong> The Act defines the two types of state ownership and provides that <strong data-start=\"1036\" data-end=\"1062\">private state property<\/strong> may be disposed of and <strong data-start=\"1086\" data-end=\"1121\">may be acquired by prescription<\/strong>, unless otherwise provided. <strong data-start=\"1150\" data-end=\"1175\">Public state property<\/strong> is outside civil circulation and <strong data-start=\"1209\" data-end=\"1247\">cannot be acquired by prescription<\/strong>.<\/p>\n<p data-start=\"1250\" data-end=\"1540\"><strong data-start=\"1250\" data-end=\"1283\">Municipal Property Act (ZOS).<\/strong> Property and chattels constituting <strong data-start=\"1319\" data-end=\"1349\">public municipal ownership<\/strong>, lands from the <strong data-start=\"1366\" data-end=\"1389\">municipal land fund<\/strong>, and <strong data-start=\"1395\" data-end=\"1427\">municipal forest territories<\/strong> <strong data-start=\"1428\" data-end=\"1466\">cannot be acquired by prescription<\/strong>. For <strong data-start=\"1472\" data-end=\"1502\">private municipal property<\/strong>, the rules of the Property Act apply.<\/p>\n<p data-start=\"1542\" data-end=\"2020\"><strong data-start=\"1542\" data-end=\"1633\">Constitutional Court \u2014 Decision No. 3 of 24.02.2022 in constitutional case No. 16\/2021.<\/strong> The Court <strong data-start=\"1644\" data-end=\"1673\">declared unconstitutional<\/strong> the moratorium\u2014effective for over 15 years\u2014by which the legislature suspended acquisitive prescription for <strong data-start=\"1781\" data-end=\"1812\">private state and municipal<\/strong> property; the decision entered into force on <strong data-start=\"1858\" data-end=\"1874\">8 March 2022<\/strong> (three days after promulgation on 4 March 2022). The <strong data-start=\"1928\" data-end=\"1977\">past effect of the suspension is not affected<\/strong>; prescription runs <strong data-start=\"1997\" data-end=\"2019\">only prospectively<\/strong>.<\/p>\n<p data-start=\"2022\" data-end=\"2364\"><strong data-start=\"2022\" data-end=\"2068\">Supreme Court of Cassation (SCC) case law.<\/strong> After 1996 (the entry into force of ZDS and ZOS), acquisitive prescription is, in principle, admissible vis-\u00e0-vis <strong data-start=\"2183\" data-end=\"2210\">private state\/municipal<\/strong> property, but its course was suspended during <strong data-start=\"2257\" data-end=\"2282\">31.05.2006\u201330.12.2017<\/strong> and <strong data-start=\"2287\" data-end=\"2312\">20.01.2018\u201307.03.2022<\/strong>. As of <strong data-start=\"2320\" data-end=\"2334\">08.03.2022<\/strong>, prescription <strong data-start=\"2349\" data-end=\"2363\">runs again<\/strong>.<\/p>\n<h3 data-start=\"2366\" data-end=\"2417\">2. Public vs. private state\/municipal ownership<\/h3>\n<p data-start=\"2419\" data-end=\"2968\"><strong data-start=\"2419\" data-end=\"2458\">Public state and municipal property<\/strong> serves public needs and is <strong data-start=\"2486\" data-end=\"2515\">outside civil circulation<\/strong>, therefore <strong data-start=\"2527\" data-end=\"2561\">not acquirable by prescription<\/strong>. Typical examples include streets, squares, water bodies, public buildings, protected areas. For <strong data-start=\"2659\" data-end=\"2695\">private state\/municipal property<\/strong>, the general rules of the Property Act apply unless a special statute provides otherwise. The boundary is determined <strong data-start=\"2813\" data-end=\"2823\">by law<\/strong>, not by factual possession or act-issuing, which is why the <strong data-start=\"2884\" data-end=\"2902\">public\/private<\/strong> qualification is a preliminary and decisive issue in any dispute.<\/p>\n<h3 data-start=\"2970\" data-end=\"3023\">3. Acquisitive prescription: elements and periods<\/h3>\n<p data-start=\"3025\" data-end=\"3147\"><strong data-start=\"3025\" data-end=\"3040\">Possession.<\/strong> Continuous, open, peaceful and unequivocal exercise of factual control <strong data-start=\"3112\" data-end=\"3134\">with animus domini<\/strong> is required.<\/p>\n<p data-start=\"3149\" data-end=\"3295\"><strong data-start=\"3149\" data-end=\"3160\">Period.<\/strong> Ordinary prescription\u2014<strong data-start=\"3183\" data-end=\"3195\">10 years<\/strong>; short prescription\u2014<strong data-start=\"3216\" data-end=\"3227\">5 years<\/strong> where there is <strong data-start=\"3243\" data-end=\"3257\">good faith<\/strong> and a <strong data-start=\"3264\" data-end=\"3294\">valid legal ground (title)<\/strong>.<\/p>\n<p data-start=\"3297\" data-end=\"3486\"><strong data-start=\"3297\" data-end=\"3312\">Good faith.<\/strong> Assessed at the time possession is acquired; the presence of a title valid in its outward form (e.g. an apparently regular but void contract) enables the short prescription.<\/p>\n<h3 data-start=\"3488\" data-end=\"3541\">4. The historical moratorium and its consequences<\/h3>\n<p data-start=\"3543\" data-end=\"4132\">In 2006 the legislature suspended acquisitive prescription over <strong data-start=\"3607\" data-end=\"3634\">private state\/municipal<\/strong> property through amendments to the Property Act, later repeatedly extended. In 2022 the Constitutional Court <strong data-start=\"3744\" data-end=\"3786\">invalidated this regime for the future<\/strong>, while confirming that its <strong data-start=\"3814\" data-end=\"3848\">past suspensive effect remains<\/strong>, i.e. the period <strong data-start=\"3866\" data-end=\"3891\">31.05.2006\u201307.03.2022<\/strong> does <strong data-start=\"3897\" data-end=\"3904\">not<\/strong> count toward the prescriptive term. From <strong data-start=\"3946\" data-end=\"3960\">08.03.2022<\/strong> prescription <strong data-start=\"3974\" data-end=\"3997\">starts or continues<\/strong> to run, depending on the facts. Courts follow this logic in declaratory actions under <strong data-start=\"4084\" data-end=\"4131\">Art. 124 CPC in conjunction with Art. 79 ZS<\/strong>.<\/p>\n<h3 data-start=\"4134\" data-end=\"4174\">5. Admissibility and starting points<\/h3>\n<p data-start=\"4176\" data-end=\"4385\"><strong data-start=\"4176\" data-end=\"4196\">Public property.<\/strong> There is an <strong data-start=\"4209\" data-end=\"4233\">absolute prohibition<\/strong> of acquisitive prescription. Even intensive factual use does not mature into prescription; the state\/municipality may reclaim the property at any time.<\/p>\n<p data-start=\"4387\" data-end=\"4673\"><strong data-start=\"4387\" data-end=\"4424\">Private state\/municipal property.<\/strong> Prescription is admissible if the requirements are met. Importantly, the 1996 reform introduced the public\/private divide, and <strong data-start=\"4552\" data-end=\"4571\">from 01.06.1996<\/strong> prescription is, in principle, possible for <strong data-start=\"4616\" data-end=\"4627\">private<\/strong> assets, with the moratorium periods excluded.<\/p>\n<h3 data-start=\"4675\" data-end=\"4712\">6. Procedural path to recognition<\/h3>\n<p data-start=\"4714\" data-end=\"5214\">Ownership is <strong data-start=\"4727\" data-end=\"4741\">recognized<\/strong> by a <strong data-start=\"4747\" data-end=\"4769\">declaratory action<\/strong> under <strong data-start=\"4776\" data-end=\"4823\">Art. 124 CPC in conjunction with Art. 79 ZS<\/strong>; the claimant bears the burden to prove possession and its attributes for the requisite period. Defendants are the respective state (through the regional governor\/competent authority) or municipality. The court examines the property\u2019s status at the relevant times, including whether it was <strong data-start=\"5114\" data-end=\"5124\">public<\/strong>. If upheld, the judgment is <strong data-start=\"5153\" data-end=\"5180\">entered in the register<\/strong> to be opposable to third parties.<\/p>\n<h3 data-start=\"5216\" data-end=\"5244\">7. Evidentiary specifics<\/h3>\n<p data-start=\"5246\" data-end=\"5602\">Possession is proved factually: witness testimony, documents for payment of taxes and fees, utility contracts in the possessor\u2019s name, inspection protocols, expert reports. It is crucial to show <strong data-start=\"5441\" data-end=\"5458\">animus domini<\/strong>, distinct from tolerated use, lease, or mere holding. For property of public entities, archival records on status over time are often required.<\/p>\n<h3 data-start=\"5604\" data-end=\"5651\">8. Defences of the state and municipalities<\/h3>\n<p data-start=\"5653\" data-end=\"5998\">Public entities may invoke <strong data-start=\"5680\" data-end=\"5707\">public ownership status<\/strong> (which excludes prescription); rely on <strong data-start=\"5747\" data-end=\"5763\">interruption<\/strong> of possession through acts of official authority; reclaim the property; or prove that the possession was <strong data-start=\"5869\" data-end=\"5904\">non-autonomous (mere detention)<\/strong>, e.g. under a contract. After <strong data-start=\"5935\" data-end=\"5949\">08.03.2022<\/strong>, the general interruption mechanisms also apply.<\/p>\n<h3 data-start=\"6000\" data-end=\"6017\">9. Conclusion<\/h3>\n<p data-start=\"6019\" data-end=\"6708\">In Bulgarian law, acquisitive prescription over state and municipal property rests on a strict distinction. <strong data-start=\"6127\" data-end=\"6137\">Public<\/strong> assets are <strong data-start=\"6149\" data-end=\"6178\">absolutely non-acquirable<\/strong>. For <strong data-start=\"6184\" data-end=\"6211\">private state\/municipal<\/strong> assets, prescription is <strong data-start=\"6236\" data-end=\"6248\">possible<\/strong>, but the historical moratorium must be accounted for: following Constitutional Court Decision No. 3\/24.02.2022, it has no effect <strong data-start=\"6378\" data-end=\"6396\">for the future<\/strong>, while the <strong data-start=\"6408\" data-end=\"6444\">suspension period is not counted<\/strong>. The possessor must prove all elements and the statutory term under the Property Act; courts must precisely qualify the property\u2019s status and account for interruptions.
