Domestic violence is a problem of major social significance, affecting the security and dignity of victims. The Bulgarian Law on Protection against Domestic Violence (LPDV) provides specific mechanisms for protection and prevention.<\/p>\n
According to Article 2 of the LPDV, domestic violence is defined as any act of physical, sexual, psychological, emotional, or economic violence, as well as forced restriction of private life and freedom. The law does not limit itself to physical acts but also covers forms such as psychological harassment or financial deprivation.<\/p>\n
Article 3 of the LPDV specifies the circle of persons entitled to seek protection \u2013 spouses and former spouses, persons in cohabitation, relatives up to the fourth degree, parents and children, as well as adopters and adoptees. This encompasses a wide range of family and close relationships.<\/p>\n
A petition for protection is filed with the district court at the victim\u2019s permanent or current address. The deadline for submission is one month from the act of violence. The petition may be accompanied by a declaration from the victim, medical documents, and witness statements.<\/p>\n
The court may impose immediate interim measures under Article 18 of the LPDV. These include, for example, prohibiting the perpetrator from approaching the victim or removing the perpetrator from the shared home. Protection orders are issued for up to 18 months and are binding.<\/p>\n
Depending on the specific case, the court may:<\/p>\n
remove the perpetrator from the home;<\/p>\n<\/li>\n
prohibit contact with the victim or visiting certain places;<\/p>\n<\/li>\n
temporarily grant parental rights;<\/p>\n<\/li>\n
oblige the perpetrator to attend programs for overcoming aggression;<\/p>\n<\/li>\n
order temporary maintenance (support) for the victim.<\/p>\n<\/li>\n<\/ul>\n
Failure to comply with a court protection order leads to an administrative fine under Article 21 of the LPDV. If the perpetrator continues with acts of violence or violates the court order, criminal liability may also apply. The Criminal Code provides sanctions for failure to comply with a court decision (Art. 296, para. 1), bodily harm (Arts. 128\u2013131), coercion (Art. 143), or threat (Art. 144).<\/p>\n
The LPDV is a key instrument for protecting victims of domestic violence. It allows for quick court intervention, the imposition of protective measures, and sanctions against perpetrators. In each case of violence, it is crucial that the victim promptly files a petition for protection and seeks the assistance of a lawyer specialized in family and criminal law.<\/p>\n
