It is determined by:<\/p>\n<ul data-start=\"1718\" data-end=\"1895\">\n<li data-start=\"1718\" data-end=\"1766\">\n<p data-start=\"1720\" data-end=\"1766\">prices of comparable properties in the area,<\/p>\n<\/li>\n<li data-start=\"1767\" data-end=\"1807\">\n<p data-start=\"1769\" data-end=\"1807\">location, infrastructure, transport,<\/p>\n<\/li>\n<li data-start=\"1808\" data-end=\"1852\">\n<p data-start=\"1810\" data-end=\"1852\">encumbrances (mortgages, rights of use),<\/p>\n<\/li>\n<li data-start=\"1853\" data-end=\"1895\">\n<p data-start=\"1855\" data-end=\"1895\">economic conditions and market demand.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"1897\" data-end=\"2057\">Case law of the Supreme Court of Cassation (2015) emphasizes that in partition proceedings, the market value is decisive to ensure fairness between co-owners.<\/p>\n<p data-start=\"2059\" data-end=\"2372\"><strong data-start=\"2059\" data-end=\"2078\">Role of experts<\/strong><br data-start=\"2078\" data-end=\"2081\" \/>The court appoints a licensed property appraiser who prepares a valuation report. The report includes a detailed description of the property and the method used to calculate its value.
