It is connected with the parents\u2019 or adoptive parents\u2019 duty to educate the child and supervise the conduct of a minor. Liability may arise where that duty has not been properly performed.<\/p>\n<p>The application of Article 48 also requires the general prerequisites for tort liability under Article 45 of the Act to be established. In addition, it must be shown that the person who caused the damage is the child of the particular parent or adoptive parent, that the latter exercises parental rights and raises the child, and that the child lives with that person.<\/p>\n<p>The liability of the parent exercising parental rights is presumed. By its nature, it is a civil-law consequence of a failure to provide the required education and supervision of a child who has not reached the age of majority. The particular circumstances, including the child\u2019s living arrangements, the exercise of parental rights, the harmful conduct, the damage and the causal link, must be examined in every case.<\/p>\n<p>This article is for general information and does not constitute legal advice.
