Parental rights after divorce and placement of a child with grandparents, relatives, or persons close to the parents<\/p>\n

When issuing a divorce judgment, whether by mutual consent or in contentious proceedings, the court rules on the personal relations between the former spouses and their minor children. In some cases the parents cannot reach agreement, or the circumstances do not allow the child to live in suitable conditions with either parent.<\/p>\n

In such cases Article 59(7) of the Bulgarian Family Code allows the court to order that the child live with the grandparents, provided that they have the necessary conditions and personal capacity, or with other relatives or even persons close to the family, with their consent. When imposing such a measure, the court also determines the parents’ contact arrangements, including how often during the week, month, year, and school holidays each parent may meet the child independently.<\/p>\n

The guiding consideration is the best interests of the child. Under the supplementary provisions of the Child Protection Act, the assessment includes:<\/p>\n

    \n
  1. the child’s wishes and feelings;<\/li>\n
  2. the child’s physical, psychological, and emotional needs;<\/li>\n
  3. the child’s age, sex, background, and other characteristics;<\/li>\n
  4. the danger or harm caused or likely to be caused to the child;<\/li>\n
  5. the parents’ ability to care for the child;<\/li>\n
  6. the consequences for the child of a change in circumstances;<\/li>\n
  7. other circumstances relevant to the child.<\/li>\n<\/ol>\n

    The court takes such a measure and places the child with grandparents, other relatives, or persons close to the parents when the child’s health or development is at risk, a protective measure is necessary, and the other available possibilities have been exhausted.<\/p>\n
